Montana voters take on Citizens United with a ballot initiative to strip corporations and nonprofits of their political spending power
Sixteen years ago, the Supreme Court decided in the Citizens United case that corporations have a First Amendment right to spend money to influence elections. On Tuesday, Montana voters will decide whether their state can take that power away.
Initiative 194, also known as the Montana Plan, would strip corporations, trade associations, nonprofits, and other organizations of the legal power to spend money supporting or opposing a political candidate or ballot initiative in Montana. Backers say they’ve found a way around Citizens United, while critics argue the semantics of the ballot initiative still violate the 2010 Supreme Court ruling.
Rather than ban corporate political donations outright, I-194 would change the powers Montana grants to corporations and other entities it refers to as “artificial persons,” limiting them to only those powers that are “necessary and convenient.”
The measure would apply to entities that do business or hold property in Montana, but exempts political action committees (PACs), news and editorial content, and individuals. Organizations that violate this would forfeit the privileges Montana grants them to do business in the state, including limited liability, which protects owners from personal responsibility for business debts.
A way around Citizens United
At first glance, the language of the ballot initiative looks like it contradicts what Citizens United established—that corporations can spend money on elections. But Tom Moore, a former chief of staff to FEC Commissioner Ellen Weintraub and now senior fellow at the Center for American Progress (who also devised the legal theory behind the Montana Plan), told Fortune that states have authority over what corporations can do through corporate law.
“When the state creates a corporation, it is starting from nothing and deciding what to give the corporation, and no case has ever held that they have to give local spending power to a corporation,” Moore said.
He said I-194 would no longer grant corporations and nonprofits the ability to spend money on elections, which is different from banning them from exercising an existing right.
“It’s not regulation; it’s redefinition,” Moore said.
He said he believes the measure would shut down dark money spending by preventing wealthy donors from hiding behind organizations that don’t disclose their contributors. For instance, a donor can give money to a nonprofit that then funnels it to a PAC, which would report the nonprofit as the donor rather than identifying the person. Moore said I-194 would cut off that route by preventing corporations, nonprofits, and trade associations from political giving, though individuals can still donate.
“This is not going to stop Elon Musk from writing a big fat check to some election in Montana,” Moore said. “What it will stop them from doing is laundering the money through a dark money group.”
But opponents of the ballot measure say the distinction between banning corporations from political giving and exercising their political rights is blurry. Bradley Smith, a former FEC chairman and professor at Capital University Law School, told Fortune states can’t sidestep the First Amendment by calling political spending a corporate power instead of a right.
“The Supreme Court isn’t engaged in a semantic game,” he said.
Smith said states can set rules for corporations, but they can’t make them surrender constitutional protections in exchange for the benefits of incorporation.
“The core centerpiece undoubtedly is we’re going to deny all corporations in the state the right to speak about political affairs and about political candidates, and that’s just going to fail,” he said.
Montana’s century-old fight against corporate interests
Montana has tried curbing corporate influence in elections before. In 1912, Montanans passed the Corrupt Practices Act by initiative with 76% of the vote, angry at the political power of mining giant Amalgamated Copper, years after the state’s mining magnates, known as the Copper Kings, had bribed state legislators.
The law barred corporations from spending money to influence elections, but the Supreme Court struck down the restriction in American Tradition Partnership v. Bullock in 2012, ruling that it conflicted with Citizens United.
Montana also isn’t the only state trying to limit corporate influence over elections. Hawaii enacted a law similar to I-194, called Act 11, in May. It’s now facing two federal lawsuits: one from the U.S. Chamber of Commerce and another from the Grassroot Institute of Hawaii, which the Institute for Free Speech, an organization Smith founded, represents. The cases could help decide whether states can use corporate law to restrict political spending despite Citizens United.
Moore expects the issue to go up to the Supreme Court, whether through I-194 or the Hawaii lawsuits. If voters approve I-194, it would take effect Jan. 1, 2027, unless a court blocks it.

Election Day is unfolding across America after a surge in early voting for the midterms
The final day of voting in this year’s midterm elections arrived Tuesday against a backdrop of uncertainty after a year in which President Donald Trump has tried to interfere in how states run their elections and sown doubts about the outcome should Republicans lose.
Millions of Americans already have cast their ballots, with early voting turnout on pace to eclipse that of the last midterm elections. In contrast to the president’s continued rhetoric about election cheating, voting so far has unfolded with relatively few problems.
Trump has spent months trying to use the power of the presidency to put his thumb on the scale of this year’s elections, which will determine whether his party keeps control of Congress.
His Justice and Homeland Security departments have been involved in a massive hunt for voters who are not U.S. citizens, at one point engaging in a made-for-the-cameras predawn operation that led to more than two dozen arrests in California. The Department of Justice was planning its largest-ever effort to monitor Election Day polling places, countered by an even larger effort among Democrats and allied groups, and at the president’s urging had sued to block certification of Alaska’s results if the outcome of the Senate race favored Democrats.
At the same time, Trump’s constant false claims about widespread voter fraud led election officials and Democratic groups across the country to plan for the possibility of immigration agents at voting sites or federal officers seizing voting machines. His administration has insisted that no armed federal officials would be guarding the polls on Election Day.
Courts have blocked the Trump administration’s efforts to influence elections
In the run-up to Tuesday, none of the steps Democrats most feared had come to pass, and the Republican administration’s legal maneuvers had been largely blocked by the courts.
One of the Trump administration’s most high-profile attempts to interfere in state elections was turned away Monday night by the U.S. Supreme Court, which rejected its push to force California to set aside thousands of ballots as part of its search for noncitizen voters. In another Monday night ruling, a federal judge said the Trump administration must stop sending voter lists of alleged noncitizens to election officials.
Even the administration’s own record of arrests and charges has demonstrated what research and state investigations have made clear for years — that instances of noncitizens casting ballots are extremely rare.
Monday’s rulings followed another defeat for the president at the Supreme Court less than two months ago, when it rejected his attempt to limit mail balloting through changes at the Postal Service. That directive was included in one of two executive orders Trump has signed during his second term that attempted to federalize certain aspects of elections, even though the Constitution gives the states, and sometimes Congress, the authority to set election rules.
Voting begins smoothly with some weather disruptions in the Southwest
The first polling sites opened at 6 a.m. EST Tuesday in a handful of states — Connecticut, Indiana, Kentucky, Louisiana, Maine, Missouri, New Jersey, New York and Virginia.
Heavy rains and flash flooding in a swath of the Southwest were expected to make it harder for some voters to reach polling places in parts of Colorado, Arizona, Utah and New Mexico. Election administrators in the Navajo Nation announced changes to several of its polling locations, and in Utah’s rural San Juan County, voters were being allowed to vote electronically on Tuesday because some of them may not be able to reach polling places.
Election administrators and voting rights advocates have been advising voters casting late absentee ballots to use drop boxes or deliver them to polling places in person rather than mail them. The advice came after concerns emerged that recent changes in U.S. Postal Service operations could result in postmarking delays that would mean mail ballots could not be counted. Late-arriving ballots or late postmarks disenfranchised tens of thousands of voters in California, Oregon and Washington, which mail ballots to all voters, during this year’s primaries.
Trump hasn’t committed to accepting the election results
The most significant disruptions ahead of Election Day were the Trump administration’s attempts to interfere. Voting rights groups, Democrats and the Justice Department have been exchanging a flurry of legal filings over alleged noncitizen voters, federal election monitors, federal intimidation of election officials and other concerns. They reveal how Trump’s attempts to expand federal control over state-run elections — combined with high-stakes races — are resulting in court battles that could extend past Election Day into ballot counting and certification of the results.
Election law experts said Trump’s lawsuits go beyond historic norms, but they said the administration’s legal arguments were unlikely to convince the courts.
Trump also has ramped up his own equivocations about whether the election will be legitimate, as he has in the past. A week before Election Day, when a reporter asked him if he would accept the results, he offered a qualified answer.
“I will if they are honest,” he said.

NYT demands Brave shut down its paywall blocker and end deals with AI firms
The New York Times and other newspaper companies sued Brave Software yesterday, alleging that the browser maker illegally bypasses paywalls and sells stolen news content to AI companies.
"Brave is the supplier, dealer, and distributor of stolen copyrighted content for its own users and many of the most prominent GenAI companies, including Anthropic, Perplexity, Mistral, xAI, and Cohere," the NYT alleged in a lawsuit filed in US District Court for the Southern District of New York. Citing third-party revenue estimates, the suit claimed that "Brave has made more than $100 million by copying and reselling publishers’ work without consent or permission," while "publishers have received nothing."
The lawsuit said, "AI companies pay Brave to provide them with real-time online content from the Brave search index," and use content from the Brave index "to train their own AI models" and "to respond to specific user queries." The NYT lawsuit points to Brave's website, which says the Brave Search API is "used by some of the biggest names in AI, including Cohere, Mistral, Perplexity, and You.com."

Claude

partner.steamgames.com/doc/gettingstarted/contentsurvey?l=schineseV 社的本意是为了增加透明度、向玩家做知情披露,但在过去几个月里,这套合规机制反倒成了不少粗制滥造复刻品的「免责声明」——

仅仅 6 天后,Nas 就为游戏《Needle In A Haystack Simulator》(大海捞针模拟器)开设了 Steam 商店页面。

距发售不到一个月的 10 月 17 日,NoGlyph 又公开指控另一款同类作品《A Game About Needle In A Haystack》抄袭自家代码。
